

As an employee, there are many types of leave provided by law that you can benefit from. However, you must first be aware of them to take advantage of them. In any case, to enjoy any type of leave, you are required to send your employer a leave request letter, preferably by registered mail with acknowledgment of receipt. Here are some common types of leave that may lead you to send a letter to your employer.

Paid leave
According to the law, any type of employee is entitled to annual paid leave at the employer’s expense. Indeed, this leave spans a duration of 25 working days or 30 calendar days, representing 5 weeks of paid leave per year at a rate of 2.5 days per month of work.

Maternity leave
Article L1225-17 of the Labor Code states that a pregnant employee is entitled to maternity leave consisting of 6 weeks of prenatal leave and 10 weeks of postnatal leave. These durations may vary according to the provisions of certain collective agreements.
Paternity leave
After the birth of his child or with whom he lives in a marital relationship, any employee has the right to send a leave request letter to his employer at least one month before the desired leave start date. This leave of 11 consecutive days, extendable to 18 days for multiple births, cannot be requested beyond four months following the birth of the child(ren).
Parental leave

This unpaid leave can be granted to any employee who wishes to take it following the birth or adoption of a child under 16 years old. Lasting 1 year and renewable twice, it cannot be granted after the child’s third birthday. A leave request letter must be sent by registered mail with acknowledgment of receipt to the company at least one month before the start of the leave, and regardless of the company’s size, the employer cannot refuse this leave.
Leave for family events
In the event of occurrences in the family (marriage, death, birth, sick child, family solidarity…), the Labor Code in its articles L3142-6 and L3142-11 provides that any employee, upon justification of the event, can claim leave not exceeding 4 days. The leave request letter to be sent to the employer must mention not only the departure date but also the duration and reason for this leave.
Business creation leave
The employee has the right to suspend his employment contract by claiming leave lasting 1 year, renewable once, to create a personal business or any type of company. The required seniority is 24 months, not necessarily consecutive, within the company.
